The defamation trial of Depp v. Heard continues and on Thursday, the jury was shown a number of photos of Johnny Depp, including one where he was "passed out" with ice cream spilled on his lap.
Another image showed him in the kitchen, a third from 2013 had a string of drug paraphernalia and lines of cocaine. During cross-examination, Depp said that the photo was taken when he had "fallen off the wagon."
Depp was asked if he drank whiskey in the morning often. He responded, "Isn't happy hour anytime?" He also said that he did recreational drugs with Marilyn Manson.
"We’ve had cocaine together maybe a couple of times," he quipped, "I once gave Marilyn Manson a pill so that he would stop talking so much."
Depp said that the day he had ice cream spilled in his lap he had worked for 17 hours and took opioids. He claimed that Heard gave him the ice cream because she "knew" he would fall asleep with it.
"If you'll notice, my right hand is in my pocket, so I wasn’t participating in the festival of ice cream," Depp said. "That was a wonderful picture for her to take."
Heard's attorney then asked if it was Heard's fault the photo was taken. Depp replied logically, "Well, she snapped it."
He also objected to the attorney's phrasing. "'Passed out' is an interesting way of putting it," he said. "Asleep?"
Other evidence included a picture of large bags of marijuana.
Heard first made allegations of abuse in 2016 when she filed for divorce and accused Depp of abusing her during the marriage. The pair eventually agreed to an expensive settlement with clauses meant to protect both Heard and Depp after the breakup, Heard continued to speak.
Heard’s 2018 Washington Post op-ed did not call out Depp by name, but Depp is suing Heard for libel over the piece. In the op-ed, Heard alleged that Depp verbally and physically abused her during the relationship. Depp is seeking $50 million in damages.
