During her testimony this week, Amber Heard was cross-examined by Johnny Depp’s legal team and questions arose about a 2016 late-night visit from James Franco caught on CCTV.
Depp's attorney, Camille Vasquez, questioned the possibility of a romantic relationship between the two, who were neighbors and had co-starred in two films together, the 2008 film Pineapple Express and more recently The Adderall Diaries in 2015.
Vasquez played the CCTV footage for the court, which shows Franco arriving at Heard’s penthouse in a hoodie and baseball cap, and at one point appears to rest his head on her shoulder.
Vasquez questioned Heard, saying, “You changed the lock to the penthouses on May 22, 2016,” to which Heard replied, “I attempted to,” in reference to her previous testimony about changing the locks after allegedly having a fight with Depp.
“That's why you felt comfortable having James Franco over the evening of May 22, 2016?" the attorney asked Heard.
Heard claimed that she couldn’t recall the details of when Franco visited her, but Vasquez pointed out the date of the CCTV footage, May 21, 2016, and that it was “past 11 p.m.” on a day when Heard “knew Mr. Depp was out of town.” This was shortly before Heard filed for divorce from Depp, on May 23.
"I don't know what I knew of his schedule at the time," Heard said.
Later on in Heard’s testimony, she told the court she and Franco were just friends and neighbors, nothing more.
“He was my friend. And he lived next door, quite literally next door,” Heard said. “And I, frankly, had exhausted my support network with my usual friends and was happy to welcome as much friendship at that time as I could possibly get.”
Additionally, the actress testified last week that Depp suspected she and Franco were having an affair.
"He hated, hated James Franco. He was accusing me of secretly having a thing with him in the past since we had done Pineapple Express together."
Franco and Heard’s ex Elon Musk are on the witness list but are not likely to testify, but Heard’s sister and actress Ellen Barkin should be testifying on Heard’s behalf sometime this week.
